FLSA Overtime Case Against Utili-Comm South filed by Gibbons Jones, P.C. On Behalf Of Cable Installers
February 24, 2010
The employment law firm of Gibbons Jones, P.C. has filed a collective action lawsuit on behalf of cable installation employees for failure to pay overtime under the Fair Labor Standards Act. The lawsuit was filed on Wednesday, February 17, 2010 on behalf of installers against Utili-Comm South, Inc., which is headquartered in Gainesville, Georgia. The case is entitled Dover et. al. v. Utili-Comm South, Inc., S.D. Ind. Case No. 1:10-cv-00199.
The named plaintiff is represented by Philip J. Gibbons, Jr. and Rebecca L. Brettin from Gibbons Jones, P.C. in Indianapolis, Indiana.
The plaintiff asserts that he was unlawfully denied overtime pay for all hours he worked over 40 in a workweek. In particular, the complaint alleges that Utili-Comm South unlawfully failed to pay its installers overtime wages by misclassifying them as independent contractors. The complaint also alleges that Utili-Comm South later reclassified its installers as employees, but continued refusing to pay overtime wages. The complaint seeks to represent installers who performed work in Indiana, Kentucky and Illinois.
